These Terms & Conditions govern your access to and use of Cre8itApp (CRE8 IT. MEDIA), cre8it.media, CRE8 IT. MEDIA services, customer accounts, portals, digital tools, social-media integrations and other services made available by CRE8 IT. MEDIA.
Cre8itApp is the application name used for CRE8 IT. MEDIA's connected social-media services. Cre8itApp and CRE8 IT. MEDIA are operated by TOFE EVENTOS, NIF/CIF B56247943, with its registered address at Paseo del Castillo 16, Ojén, Málaga, Andalucía 29610, Spain.
By accessing or using CRE8 services, creating an account, connecting a third-party platform, purchasing a service or otherwise engaging CRE8 to provide services, you agree to these Terms to the extent applicable to your use of the service.
If you are using CRE8 on behalf of a business or other organisation, you confirm that you have authority to act on behalf of that organisation.
2. CRE8 SERVICES
CRE8 IT. MEDIA provides digital marketing, advertising, creative, social-media, website, content and related technology services.
Depending on the service selected, CRE8 services may include advertising creative, UGC-style content, campaign strategy, paid-media support, social-media management, website design or development, digital content, AI-assisted analysis, social-media auditing, reporting, customer portals, connected social-media tools and other marketing or technology services.
The availability, features, specifications and pricing of individual services may change as CRE8 develops.
Specific proposals, quotations, packages, order forms, statements of work or service agreements may contain additional terms. Where there is a conflict, the more specific written agreement relating to that service will normally take precedence.
3. ACCOUNTS
Some CRE8 services may require you to create an account or customer profile.
You agree to provide accurate and reasonably current information and to update information where necessary.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account where that activity results from your authorised use or failure to protect your credentials.
You must notify CRE8 promptly if you believe your account has been accessed or used without authorisation.
CRE8 may suspend access where reasonably necessary to protect the customer, CRE8, other users or connected services.
4. BUSINESS INFORMATION & CONTENT
You may provide CRE8 with business information, product information, photographs, video, logos, trademarks, brand guidelines, advertising materials, website information, customer information or other content required to provide a requested service.
You retain ownership of content and intellectual property that you own and provide to CRE8.
You grant CRE8 a non-exclusive licence to host, copy, process, adapt, resize, format and otherwise use supplied content only as reasonably necessary to provide, operate, support or improve the services you have requested.
You confirm that you have the necessary rights and permissions to provide that content to CRE8 and to authorise its use for the requested purpose.
5. SOCIAL-MEDIA CONNECTIONS
CRE8 may allow customers to connect third-party social-media accounts, including Facebook, Instagram and TikTok.
Connections are made using the relevant platform's official authentication or authorisation systems where available.
By connecting an account, you authorise CRE8 to access and process the information and functionality covered by the permissions you approve.
Depending on the CRE8 service and permissions granted, this may include profile information, account or page information, posts, videos, captions, media, engagement information, analytics, performance data and other authorised platform information.
You remain responsible for ensuring that you are authorised to connect the relevant account to CRE8.
6. FACEBOOK & INSTAGRAM
CRE8 may integrate with services and APIs supplied by Meta Platforms for Facebook and Instagram functionality.
You authorise CRE8 to use the permissions you expressly grant through Meta's authentication systems for the CRE8 features you choose to use.
CRE8's ability to access or provide Facebook and Instagram functionality depends on Meta's APIs, permissions, policies, availability and technical systems.
Meta may change, restrict or withdraw APIs, permissions or functionality independently of CRE8. CRE8 is not responsible for interruptions or limitations caused by such third-party changes.
7. TIKTOK
Cre8itApp (CRE8 IT. MEDIA) may integrate with TikTok through TikTok Login Kit, Display API, Content Posting API or other authorised TikTok developer services.
By connecting TikTok to Cre8itApp, you authorise Cre8itApp (CRE8 IT. MEDIA) to access only those TikTok permissions that you approve through TikTok's official authorisation process.
Depending on the Cre8itApp feature selected, TikTok integrations may be used to display connected account information within CRE8 IT. MEDIA, import authorised content, analyse social-media activity or, where separately enabled and authorised, assist with content publishing.
TikTok controls the availability and operation of its platform, APIs and permissions. Changes made by TikTok may affect Cre8itApp or CRE8 IT. MEDIA functionality without prior notice.
8. SOCIAL PUBLISHING & SCHEDULING
Where CRE8 offers social-media publishing, scheduling or content-submission functionality, you remain responsible for reviewing and approving content before publication unless a separate service agreement expressly provides otherwise.
By instructing CRE8 to publish or schedule content, you confirm that the content is authorised for publication and complies with applicable laws, advertising requirements and the rules of the relevant platform.
Publishing may depend on third-party APIs, permissions, account status, platform review systems and technical availability.
CRE8 cannot guarantee that a third-party platform will accept, publish, distribute or continue displaying any particular item of content.
9. AI & AUTOMATED TOOLS
CRE8 may use artificial intelligence, machine-learning systems and other automated tools to assist with creative production, analysis, recommendations, reporting, research, content development and other CRE8 services.
This may include CRE8's AI Social Audit and future CRE8 creative or marketing tools.
AI-generated or AI-assisted outputs may contain errors, omissions or unexpected results and should be reviewed before publication or reliance.
CRE8 does not guarantee that AI-generated recommendations, predictions, advertising ideas, content or other outputs will produce any particular commercial result.
10. AI SOCIAL AUDIT
CRE8's AI Social Audit may analyse authorised social-media content, account information and performance information to identify patterns and produce observations or recommendations.
Audit results are provided as marketing guidance and informational analysis.
They are not guarantees of future reach, engagement, sales, revenue, profitability or advertising performance.
Marketing performance can be affected by factors outside CRE8's control, including market conditions, platform algorithms, competition, pricing, product quality, customer demand and advertising budgets.
11. CREATIVE & ADVERTISING SERVICES
Creative concepts, advertisements, UGC-style content, campaign ideas and other materials produced by CRE8 are developed based on the information, assets, instructions and objectives available at the time.
Where customer approval is required, you are responsible for reviewing names, prices, claims, product information, spelling, imagery, offers and other factual information before final approval or publication.
CRE8 may recommend creative approaches, audiences, platforms, budgets or campaign structures but does not guarantee a specific advertising outcome.
Advertising platforms ultimately control ad review, approval, delivery, account restrictions, auction results and platform-level performance.
12. WEBSITES & DIGITAL PROJECTS
Where CRE8 designs or develops websites, landing pages, databases, portals or other digital products, the agreed scope will be determined by the relevant package, proposal or project agreement.
Third-party hosting, domain, software, plugin, API, database, payment, email or platform services may be required for a digital project to function.
CRE8 is not responsible for outages, policy changes or technical failures caused solely by third-party services outside CRE8's reasonable control.
Customers are responsible for maintaining any third-party subscriptions or accounts that are identified as their responsibility.
13. PRICING & PAYMENTS
Prices displayed on the CRE8 website or supplied in a quotation are subject to the terms shown with the relevant service.
Prices may be stated as one-off charges, monthly charges, project fees or other billing arrangements.
Applicable taxes may be added where required by law.
Where payment is required before work begins, CRE8 is not required to commence the relevant work until payment has been successfully received.
Third-party advertising spend, platform charges, creator costs, production expenses, subscriptions or other external costs are not included unless expressly stated.
14. SUBSCRIPTIONS & RECURRING SERVICES
Some CRE8 services may be offered on a monthly or recurring basis.
The price, billing frequency, included services and applicable cancellation conditions will be shown in the relevant package, checkout process, proposal or service agreement.
Unless otherwise agreed, changes to a recurring service take effect in accordance with the terms applicable to that service.
CRE8 may change future subscription pricing by providing appropriate notice where required.
15. CANCELLATIONS & REFUNDS
Cancellation and refund rights depend on the type of service purchased, whether work has commenced, whether the service is personalised and any mandatory consumer rights that apply.
Many CRE8 services involve personalised creative, advertising, digital or professional work. Once work has commenced at your request, cancellation or refund rights may be limited to the extent permitted by law.
Nothing in these Terms removes any mandatory cancellation, refund or consumer rights that cannot legally be excluded.
Where a separate proposal, order or service agreement specifies cancellation terms, those specific terms will apply to that service.
16. CRE8 VIP, CLUB & REWARDS
CRE8 may offer optional membership, loyalty, VIP or rewards programmes including CRE8 VIP or CRE8 Club.
Programme features may include points, membership tiers, rewards, events, training, offers, member benefits, wallet passes and other promotional features.
Unless expressly stated otherwise, points and promotional rewards have no cash value and cannot be exchanged for cash.
CRE8 may establish reasonable rules concerning points earning, expiry, redemption, reward availability and membership tiers.
CRE8 may change or withdraw rewards or programme features where reasonably necessary, subject to applicable law and any specific terms supplied with the programme.
17. APPLE WALLET & GOOGLE WALLET PASSES
CRE8 may offer personalised digital membership or loyalty passes for compatible wallet services.
Wallet passes may contain information including a member or business name, logo or profile image, membership identifier, tier, points balance, rewards, QR code, barcode or other membership information.
Pass information may update automatically when relevant membership information changes.
Wallet functionality depends on third-party providers and the relevant Apple, Google or wallet platform services.
CRE8 cannot guarantee continuous availability of third-party wallet functionality.
18. MARKETING COMMUNICATIONS
Where you expressly opt in to CRE8 marketing, CRE8 may send marketing communications including creative ideas, service updates, offers, CRE8 VIP information, rewards, events or other relevant communications.
You can withdraw marketing consent at any time using an unsubscribe mechanism provided in marketing communications or by contacting CRE8.
Service, security, transaction or account-related messages may still be sent where they are necessary to provide an active CRE8 service.
19. INTELLECTUAL PROPERTY
The CRE8 IT. MEDIA name, website design, branding, logos, software, code, templates, processes, original website content and other CRE8-owned materials are protected by applicable intellectual-property laws.
Except where expressly authorised, you may not reproduce, distribute, sell, license, reverse engineer or commercially exploit CRE8-owned materials.
Ownership or usage rights for customer-specific creative deliverables may be defined by the package, proposal or agreement under which those deliverables are produced.
Third-party assets remain subject to the rights and licence terms of their respective owners.
20. PORTFOLIO & CRE8 PROMOTION
CRE8 will not assume that confidential customer information may be publicly disclosed.
Where CRE8 wishes to feature customer work, branding, campaigns, testimonials or results in its portfolio, website, social channels or sales materials, CRE8 may seek permission where appropriate or rely on an existing agreement that expressly permits such use.
Any confidential information identified as confidential will be treated accordingly.
21. ACCEPTABLE USE
You must not use CRE8 services for unlawful, fraudulent, deceptive, abusive or malicious purposes.
You must not attempt to gain unauthorised access to CRE8 systems, interfere with security controls, introduce malicious software, scrape protected information without authorisation or use CRE8 in a way that infringes another person's rights.
You must not use connected-platform functionality in violation of the rules or policies of Facebook, Instagram, TikTok or another relevant third-party platform.
CRE8 may suspend or terminate access where reasonably necessary to prevent misuse or protect CRE8, customers or third parties.
22. THIRD-PARTY SERVICES
CRE8 relies on third-party services to provide parts of its functionality.
These may include Framer, Supabase, Vercel, email providers, payment processors, analytics providers, AI providers, Meta, TikTok, Google, Apple, wallet-pass providers and other technology services.
Your use of certain functionality may therefore also be subject to the terms and policies of the relevant third-party provider.
CRE8 is not responsible for a third party's independent actions, policies, outages, account decisions or service changes.
23. SERVICE AVAILABILITY
CRE8 aims to provide reliable services but does not guarantee that every website, portal, API connection, integration or digital service will operate without interruption.
Maintenance, software updates, third-party outages, security incidents, platform changes or circumstances outside CRE8's reasonable control may temporarily affect availability.
CRE8 may modify, maintain, update or replace functionality as reasonably necessary to improve or secure the service.
24. NO GUARANTEE OF MARKETING RESULTS
Marketing and advertising performance is influenced by many factors outside CRE8's control.
Unless CRE8 expressly agrees otherwise in writing, CRE8 does not guarantee specific levels of sales, leads, impressions, followers, engagement, return on advertising spend, search ranking, website traffic or revenue.
Any forecasts, estimates, examples, case studies or performance projections are illustrative and should not be treated as guarantees.
25. CUSTOMER RESPONSIBILITIES
You are responsible for providing information, approvals, access and materials reasonably required for CRE8 to deliver the agreed service.
You are responsible for ensuring that factual claims, prices, product details, promotions, regulatory statements and other information supplied by you are accurate and lawful.
Delays in providing required information, approvals or access may affect project timelines or service delivery.
26. CONFIDENTIALITY
Where CRE8 receives non-public business information in connection with providing services, CRE8 will use reasonable care to protect that information and use it for the purpose of providing or supporting the relevant service.
Confidentiality obligations do not apply to information that is already public through no breach of obligation, independently developed without use of confidential information, lawfully received from another source or required to be disclosed by law.
27. DATA PROTECTION
Personal data processed through CRE8 services is handled in accordance with the CRE8 Privacy Policy and applicable data-protection law.
Where CRE8 processes personal data on behalf of a business customer as a processor rather than a controller, additional data-processing terms may be required depending on the nature of the service.
Customers remain responsible for their own obligations under applicable privacy and data-protection law when providing personal data to CRE8.
28. SUSPENSION & TERMINATION
You may stop using CRE8 services subject to any applicable contractual, subscription or payment obligations.
CRE8 may suspend or terminate access where you materially breach these Terms, fail to make required payments, misuse CRE8 services, create a security risk or use CRE8 in a way that may violate applicable law or third-party platform rules.
Where reasonably possible and appropriate, CRE8 will attempt to provide notice before terminating an ongoing customer service for breach.
29. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.
To the maximum extent permitted by applicable law, CRE8 is not responsible for indirect or consequential losses, loss of anticipated profits, loss caused solely by third-party platform outages or changes, or business outcomes that CRE8 has not expressly guaranteed.
Any limitation of liability applicable to a particular paid project may also be set out in the relevant proposal or service agreement.
These Terms do not limit mandatory rights available to consumers under applicable law.
30. FORCE MAJEURE
CRE8 will not be responsible for delay or failure caused by circumstances beyond its reasonable control.
Such circumstances may include major internet or cloud outages, natural disasters, government action, widespread cyber incidents, labour disruption, war, civil disturbance or failure of essential third-party infrastructure.
31. CHANGES TO THESE TERMS
CRE8 may update these Terms as our services, technology, integrations or legal obligations change.
The latest version will be published on cre8it.media.
Where changes materially affect an ongoing paid service, additional notice may be provided where required by law or the applicable service agreement.
32. GOVERNING LAW
These Terms are governed by the laws of Spain, subject to any mandatory consumer-protection rules or jurisdictional rights that apply to you.
Where legally permitted, disputes relating to CRE8 services will be subject to the competent courts determined under applicable Spanish and European law.
